Are Tenants Responsible for Mould? UK Landlord & Tenant Rules Explained

Mould is one of the most common and most argued-about  problems in rented homes. When black spots start creeping across a bathroom ceiling or behind a wardrobe, the first question both sides ask is the same: whose fault is this, and who has to fix it? The honest answer is that responsibility is shared, but the bulk of the legal duty sits with the landlord, not the tenant. What the law actually says In the UK, landlords have a clear statutory duty to keep a property safe and fit to live in. Under the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018, a rented home must be free from serious hazards and damp and mould are specifically listed as hazards under the Housing Health and Safety Rating System.
